Virginia Code § 2.2-3706 supplies the main public-record basis for requesting an adult photograph taken during initial intake or routine booking. A later state corrections image, if one exists and is releasable, belongs to the VADOC record. News images may depict an arrest or agency event without being the routine intake photo. Do not infer a release from the photo’s presence or absence. A current VBSO mugshot supports a present public listing at the time checked. A saved or republished image may outlive both custody and the case. Confirm release through VBSO’s transaction, Jail VINE, the court, and any receiving agency.
VBSO Roster Photo Limits
The VBSO homepage describes the official lookup as showing charges, bonding information, and mugshots for current Virginia Beach Correctional Center inmates. No official release date, release reason, released-person filter, or photo retention term was documented. This makes the online image useful during current custody but unreliable as an archive after release.
No official VBSO mobile inmate or recent-release application was identified through the agency navigation and source inventory. GettingOut serves communications with current inmates. It is not a sheriff release-feed or historical booking-photo system. The lack of an identified app should be stated narrowly because another product might exist without being an official records channel.
When the current record has disappeared, use the Virginia Beach same-day release sources to confirm what happened, then request the photo from VBSO. - Request an electronic copy and ask for a cost estimate before work exceeds a chosen amount.

Virginia FOIA does not always require a written request or the word “FOIA,” but writing helps define the record. A public body generally has five working days to respond. These channels may preserve public correctional news or photographs, but the report does not call them release feeds. A social post can document what the agency said on its publication date. It cannot replace a jail transaction or court disposition.
Local news and commercial databases may also carry a photo. No commercial mugshot publisher or data broker is linked here. Such copies can be old, cropped, misidentified, or separated from a later dismissal, acquittal, sealing order, or release. Do not rely on a caption alone. Confirm the name, booking episode, official source, and current case record before drawing any conclusion.

Virginia Beach Mugshot Removal Law
Virginia Code § 8.01-40.3 is an anti-pay-to-remove remedy, not a blanket ban on publishing booking photos. It creates civil liability when a publisher maintains or spreads criminal-history information about a charge or arrest and solicits, requests, or accepts value to remove it. The statute provides actual damages or $500, whichever is greater, plus reasonable fees and costs, subject to its terms and exceptions.
Do not pay or endorse a removal service based only on a demand attached to a photo. Preserve the page, date, request, and payment demand if the statute may apply. Legal advice may be needed for a specific claim. For an inaccurate official record, contact the agency that maintains it and provide a court order or identity document that establishes the correction.
A removal claim and a release check answer different questions. A person can be released while the booking record remains accessible. Conversely, a photo may be withheld or removed while a public court or custody record still exists. Use the official custody and court sources to verify the event rather than treating image visibility as status.
Virginia Beach Sealing Effects
Virginia expungement law is date-sensitive. The version of § 19.2-392.2 effective before December 1, 2026, permits petitions in specified outcomes such as acquittal, nolle prosequi, or dismissal, as well as some identity-error cases. A new version takes effect on that date. The law in force when relief is sought controls.
Virginia’s separate sealing chapter changes public inspection under its own rules and exceptions. An expungement or sealing order affects official police, court, and criminal-history visibility as the law directs. A person may leave VBCC by transferring to the Virginia Department of Corrections. That is a custody handoff, not a community release.
